Establishment of Resident Representative Offices-Application Procedures
1. Applicant appoints an agent, which must be a foreign investment services company in the mainland.


2.Agent submits on applicant’s behalf all the required documents to the provincial foreign trade and economic cooperation department for handling application procedures.


3.Upon approval granted, applicant should proceed promptly to the provincial or municipal administration for industry and commerce for registration.


4.Other formalities to be handled by the resident representative: Complete residence application procedures with local public security bureau by presenting registration certificate, representative certificate and approval certificate; Apply for opening bank account by presenting registration certificate and approval certificate to local foreign exchange administration; Apply to Customs for permission to import office equipment, daily necessities and transport vehicles for use by the representative office and its personnel; Complete tax payment registration procedure at local tax office; Appoint local foreign service company to recruit local staff.

 


Establishment of Resident Representative Offices-Documents Required
1.An application letter signed by the chairman or general manager of the applicant enterprise, the content should include a brief introduction of the enterprise, the objectives of the resident representative office, the name of the office, resident personnel (chief representative and representatives), scope of business, length of residence and office address;


2.A completed application form for establishment of resident representative offices of foreign enterprises, or completed application form for establishment of resident representative offices of Taiwan, Hong Kong and Macau enterprises;


3.A notarised business licence (copy) issued by the authorities in the country or region where the applicant is located, and photocopy of valid business registration certificate;


4.The original copy of credit report issued by the bank where the applicant maintains its account (documents in foreign language must be accompanied by Chinese translations);


5.Power of attorney for representative office staff signed by the chairman or general manager and stamped with company chop;


6.Detailed resumes (from secondary school education to present) of authorised personnel (representatives);


7.Identity card, visa and other valid documents of the authorised personnel (representatives) issued by their country or region of origin; and the mainland travel permit (photocopy) for Hong Kong and Macau personnel;


8.Copies of business records with relevant enterprises in China;


9.Certificate of utilisation for premises (such as hotel) where the representative office is located.
