China is seeking to attract foreign talents to come to China to start companies and drive innovation. They will target three groups of foreigners one will be existing talent, two will be promising young people, and three will be foreign-born Chinese. They will make it easier for them to get long term work or student visas and even permeant residence.

Since 2015 China has made different kind of special zones in China where foreigners can more easily do business. They are in 16 provinces and municipalities, including, Shanghai, Beijing, Fujian, and Guangdong. These areas have extensive measures to attract and retain foreign talents and help nurture their businesses or valuable research.

China is looking to expand on these programs across the country. The rules that applied to many special free trade zones, may apply nation-wide. The 12 policy measures for innovation, entrepreneurship, investment, and learning in China were replicated and implemented nationwide on August 1, 2019. It mainly covers four aspects:

I.Expand the scope of foreign residents applying for permanent residence
Foreigners with high-level foreign talents, foreign Chinese with doctoral degrees or long-term work in key national development areas, foreign talents with outstanding contributions and special needs of the country, long-term foreigners working in China who meet wage annual income standards and taxation standards To provide an application for permanent residence in China, the foreign spouse and minor children of the above-mentioned personnel may apply together.

II.Relaxation of the scope of the issuance of long-term visas and residence permits

Optimize the business environment and issue long-term valid visas and residence permits for foreigners who come to China for business, work or study. For foreign key talents, foreign high-level talent work teams and support personnel who are invited to come to China to engage in technical cooperation, economic and trade activities, and foreign talents working in China, key domestic institutions of higher learning, research institutes, and well-known enterprises, issue a valid visa for 2-5 years or Residence permit.

III.Broaden the scope of foreign talent introduction

Providing services for foreign outstanding young people in China for entrepreneurship and innovation, and providing visas and residence for foreign students who have graduated from domestic key universities and internationally renowned universities in China, such as innovation and entrepreneurship in China, and domestically renowned enterprises and institutions to invite internships in China. Licensing policy support and convenience services.

IV.Improve the service management level for foreigners

Exploring the establishment of immigration service centers (sites) in areas where foreigners are concentrated, providing job counseling, residence travel, legal aid, language and culture, and other work and life convenience services for resident foreigners.

12 New Immigration Measures:

1.Foreigners with high-level foreign talents, outstanding contributions, and special needs of the state may apply to the exit and entry administrative department of the public security organ for permanent residence in China after being recommended by the relevant state administrative department, the provincial people's government or the national key development regional administrative department. . Foreign spouses and minor children of the above-mentioned persons may apply together.

2.Foreigners working in China have worked continuously for 4 years and live for at least 6 months each year. The annual income of wages is not less than six times the average salary of the employees in the towns where the previous year was located, and the annual income tax is paid. Not less than 20% of the wage annual income standard, you can apply to the exit and entry management department of the public security organ for permanent residence in China. Their spouses and children can apply together.

3.Foreign Chinese working in China have a doctoral degree or have worked in the national key development area for 4 years and live for at least 6 months each year. They can apply for permanent residence from the Exit and Entry Administration Department of Public Security in China. Their spouses and children can apply together.

4.Foreign experts and scholars invited by domestic key institutions, research institutes and well-known enterprises, as well as foreign high-level management and professional and technical personnel recognized by the competent department of talents of the people's government at or above the municipal level and the competent department of scientific and technological innovation. They can apply for a port visa from Port Visa Department of Public Security. After the entry, the applicant's letter of approval and other materials can be used to apply for multiple visas or residence permits within five years of the validity of the Entry and Exit Administration Department of Public Security.

5.Foreign talents and innovative entrepreneurial team members introduced in key domestic development areas and industries may apply for residence permit within 5 years from the Entry and Exit Administration Department of Public Security with work permits and letter of that organization. Foreign members of the Innovation and Entrepreneurship Team may also apply for a residence permit of 5 years of validity with the letter of guarantee from the team leader.

6.Foreigners with significant outstanding contributions and special needs of the state can recommend foreign members and research assistants of the team they lead, and apply for long-term visas or residence permits of 5 years of validity tothe Entry and Exit Administration Department of Public Security .

7.If a foreigner employed by an enterprise or institution in China has completed the work permit procedure and has no time to go out of China for the work visa, he can apply for a resident permit at the Entry and Exit Administration Department of Public Security with the work permit and other materials; If he/she has applied for the residence permit with more than one-year validity twice, and there is no violation of laws and regulations, the third time application for a residence permit may be submitted to the Entry and Exit Administration Department of Public Security for a five years validity.

8.Foreign talents working in key domestic institutions research institutes and well-known enterprises, after they are approved by the work organization employer and filed with the Entry and Exit Administration Department of Public Security, they are supported for doing part-time innovation and entrepreneurship.

9.Foreign excellent students who have obtained bachelor degree or above in key domestic institutions of higher learning, who are engaged in innovation and entrepreneurship activities in China after graduation, can apply for the 2-5 years residence permit from the Entry and Exit Administration Department of Public Security, with the graduation certificate of university and other innovation and entrepreneurship materials.

10.Foreign students who graduated from internationally renowned universities and who come to China for innovation and entrepreneurship within 2 years after graduation can apply for a residence permit of 2 years validity from the Entry and Exit Administration Department of Public Security with materials such as academic qualifications (degrees).

11.Foreign students from overseas universities invited by domestic well-known enterprises and institutions for internships in China, with the letter of the inviting organization and the proof of university he/she studied, can apply for a one-year visa for the internship activity from the Entry and Exit Administration Department of Public Security, Foreign students from overseas universities who are internships in China under intergovernmental programs can apply for a residence permit under relevant regulations.

12.To establish immigration service centers (sites) in areas where foreigners are concentrated, providing job counseling, legal aid, language and culture, etc. for foreigners.
