China trademark transfer is one of Tannet’s intellectual property services. Trademark transfer is the behavior of the trademark registrant in the period of validity of the registered trademark, according to the law procedures, transfer the right to exclusive use of the trademark to the other party. There are several forms of trademark transfer: contract transfer, subsequent transfer, and transfer due to administrative order.
Trademark transfer is required in the following cases
1. If a registered trademark is transferred to another person, it shall go through the transfer procedure of the registered trademark to the Trademark Office.
2. If the right of exclusive use of the trademark occurs when the enterprise has merged, merged or reformed, it shall go through the formalities of transferring the registered trademark to the trademark office.
3. If the right of exclusive use of the trademark has been transferred according to the judgment of the court, the transfer procedure shall also be carried out. Since September 15, 2002, the trademark that has been applied but has not been registered can also be applied for transfer.
Required Materials
1. Power of Attorney;
2. Application for the Transfer of Registered Trademark;
3. Identity document (copy) of the assignor and the assignee;
4. Trademark transfer agreement;
5. Copy of Trademark Acceptance Notice or Trademark Certificate.
Note: All of the above transfer stamp or signature should be consistent with the application. If the transfer application does not comply with the law, the Trademark Office will notify the applicant in writing in accordance with the address specified in the application to provide a notarized or certified transfer agreement or transfer statement within a period of time .
General Procedure
The process of trademark transfer includes: Application --- Acceptance --- Examination --- Publication --- Issuance of transfer certificate.
1. If the registered trademark is transferred, the trademark registrant shall transfer the same or similar trademarks registered on the same or similar goods.
2. If the transfer application does not comply with the provisions of the law, the Trademark Office will notify the applicant in writing in accordance with the address in writing via mail to correct within a period of time.
3. After the application for approval of the transfer, the Trademark Office will issue the transfer certificate to the transferee in accordance with the address specified in the application, and publish the issue of the transfer of the trademark. The inscribed date on the certificate is publication date, the assignee shall enjoy the exclusive right of trademark since that date.
4. If the transfer application is not approved for other reasons, the Trademark Office will notify the applicant in writing in accordance with the address specified in the application form.
5. The relevant notices or certificates of the Trademark Office are only issued to the representatives of the assignee in the transfer application. If other co owners need to prove it, they should apply for re-issuance
6. The classification of application forms should be completed in accordance with the international classification category approved by the Trademark Registration Certificate.
