China trademark renewal application should be filed before its validity period to due. Trademark is a kind of intellectual property. Intellectual property right refers to the right that people enjoy for their own intellectual activities and the marks and reputation of their management activities. Intellectual property right is a kind of intangible property right, which is protected by the state law as the tangible property such as house and car. All of them are provided with intangible value or use value. Therefore, people are paying more and more attention to the protection of intellectual property rights.
Generally speaking, intellectual property rights can be divided into three categories: trademark right, patent right and copyright. This article mainly introduces trademark renewal in China.
Introduction to Trademark Renewal in China
Registration of Chinese trademarks is valid for 10 years. If the owner of the mark wants to continue to use after the expiration, he/she shall file an renewal application within 6 months before the expiration. In case of failure in filing application during such period, there is a six-month grace period. If the owner of the mark fails to apply for the renewal within the grace period, the mark will be canceled by the trademark office after the expiration. The trademark office will grant a trademark renewal certificate after examination to the renewal application. The renewal certificate has the same legal force with the original registration certificate.
Conditions for Trademark Renewal
According to the 38th provisions of the current trademark law of China, registered trademark that need to use after expiration shall apply of renewal within six month before the expiration. Those fail to file the application during such period can be given a grace period of six months. If there is still no application within the six-month of grace period, the mark will be canceled.
Required Materials
1. Identity proof of the applicant (copy);
2. Copy of trademark registration certificate;
3. Trademark renewal documents with signature;
4. If the application document is in foreign language, the Chinese translation shall also be provided with the signature of the translation agency.
