Period of Malaysia Industrial Design Registration
Previously, industrial design registration is given an initial protection period of 5 years from the date of filing and there is extension period for four further consecutive terms of 5 years each after implemented the Industrial Design (Amendment) Act 2013 in Malaysia. Moreover, the maximum protection period for the registered industrial design has also been increased from 15 years to 25 years by following the Amending Act. Registered Malaysia Industrial Design as Personal Property
Another industrial design advantage is to extend the scope of the registered industrial design to declare it as a personal property to the owner through the Amending Act. Generally, the Act stated that a registered industrial design is capable to be sold. Therefore, the Amending Act will clarify the attributes of a registered industrial design to be a personal property and also allow a registered industrial design to be used as security for loan from the banks in Malaysia.
Protection of Industrial Design in Malaysia
Based on the Industrial Design Act 1966, it has stated that only the original owner of the industrial design is entitled to apply for the registration of the industrial design. Furthermore, the owner of a registered industrial design has the right to stop the other person to copy his or her design. It means that the owner of the registered industrial design may grant a license to any person to use that registered industrial design.
