The grant of a short-term patent in Hong Kong is based on a search report from an international searching authority or one of three designated patent offices. A short-term patent application in Hong Kong is made by filling a request for grant of short-term patent supported by the documents and information required.
Required documents for Hong Kong Short-term Patent application
1) a request for grant on Patents Form P6;
2) a specification (section 113(1)(b), Patents Ordinance and sections 58(2), 59, 60 and 64, Patents (General) Rules);
3) an abstract in both English and Chinese (section 61, Patents (General) Rules);
4) the title of invention in both English and Chinese;
5)applicant's name and address;
6)inventor's name and address;
7)a search report (see the paragraph below);
8)if you are not the inventor, a statement on Patents Form P6A indicating your entitlement to the short-term patent;
9)if priority is claimed, a statement of priority and priority documents (section 69, Patents (General) Rules);
10)if non-prejudicial disclosure is claimed, a statement and written evidence to support the claim (sections 58 and 70, Patents (General) Rules);
11)an address for service in Hong Kong, China;
12)translations of information and documents as required.
Hong Kong Short-term Patent application Flow
Examination of the filling date:
Shortly after receiving the application, the Registry will send a notice to the applicant, giving the filing date of the application.
Formality Examination:
After giving the filing date to the applicant, the Registry will examine the formalities of the application. The formalities are the information required in the application from and the supporting documents. There is no substantive examination of the application (e.g. the novelty and inventiveness of the invention) and the Registry does not search records of prior registered patents.
If the application is not in order, the Registry will give notice to the applicant to correct the deficiencies within two months. Failure to correct deficiencies may result in the application being deemed withdrawn.
Publication and Grant:
If an application is in order, the Registry will publish the patent application or grant a patent, publish the patent application or advertise the grant by notice in the Hong Kong Intellectual Property Journal and issue a certificate of grant of patent (only applicable to request for registration and grant of standard patent and application for short-term patent).Protection under a short-term patent is renewable after the end of the fourth year, up to a maximum term of eight years.
