Ukraine trademark registration is mandatory to be granted rights over a trademark, as it is a "first to file" jurisdiction. The trademark applications must be filed with the Ukrainian Intellectual Property Institute (UIPV). Ukraine is a member state to the Madrid Protocol. Thus, the extension of an international registration of a trademark via the Madrid System is possible for this country. Below is a brief introduction to trademark registration in Ukraine.
Documents required for filing trademark application
- Filing particulars - name, country of incorporation or residence and address of the Applicant(s);
- the claimed mark;
- the list of goods for which the trademark registration is applied for;
- Power of Attorney signed by authorized person on behalf of Applicant (no notarization or legalization is needed);
POA form shall be filed within two month since the filing the application. Please find attached a Power of Attorney form to be duly executed by applicant should you decide to proceed through our firm;
- Certified copy of the priority application (in case of claiming priority according to Paris Convention).
Trademark Registration Procedure
After the completion of filing procedure, the Official Notification of the receipt of the application is issued within 1-3 months and the application is published in the official online database, after that the Ukrainian trademark application undergoes substantive examination for about 9-11 months. On condition that the trademark meets the requirements of protectability, the grant decision is issued. If the registration and publication fees are paid in due course the trademark is registered, published and the certificate of registration is issued within 2-3 months.
Generally speaking, the entire procedure of trademark registration in Ukraine takes from 14 to 16 months.
Note: Foreign applicants must be represented before the Office by a registered Ukrainian trademark attorney.
Trademark Validity and Renewal
A trademark in Ukraine is valid for 10 years from the filing date and can be further renewed every 10 years. In Ukraine it is possible to apply for a renewal of a trademark within 6 months before the deadline. There is also a 6-month grace period which allows applying for a renewal after the deadline upon payment of a stipulated fine. Reinstatement of a lapsed trademark (after grace period expiration) is not possible.
