Sweden trademark application can register either locally via the Swedish Patent and Registration Office, or regionally by filing a European Union Trademarks (EUTM) which grants protection in the whole European Union. It is not necessary for a trademark to be in use in Sweden in order for it to register. However, prior use may be useful as it can help overcome an objection raised on the grounds of lack of distinctiveness.
Registerable marks in Sweden
A trademark in Sweden may consist of any signs capable of being represented graphically, particularly words, including personal names, figurative elements, letters, numerals, and the shape of goods or their packaging, provided that the signs are distinctive.
Requirements for a trademark application in Sweden
1. Full name and address of applicant;
2. Information about trademark, if a figurative mark a representation in jpg format is needed;
3. Information about goods and services, preferably in English;
4. If there is a priority claim, we need a certified copy of priority application as well as a verified English translation thereof, if application is not in English.
Note: Legalization of a Power of Attorney is not required. It may be provided later, i.e. within one month from filing the Swedish trademark application.
Processing Time
If there is no office action, time frame from application to registration is about 4 - 5 months. In Sweden trademarks are published for opposition on the same date as the registration certificate is issued, opposition period is three months.
Validity term and trademark renewal
Valid Term
The trademark registration in Sweden is valid for 10 years from the date of registration. An application for renewal shall be filed with the Patent and Registration Office no earlier than 1 year before and no later than 6 months after the expiry of the registration period.
