You may wish to register a trade mark internationally. A single international registration is equivalent to a bundle of national registrations. A European Union Trade Mark (EUTM) provides trade mark protection in all 27 member states of the European Union through one registration, namely: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden.

 

1, What a trademark protects
Registering a trade mark gives you exclusive rights (The holder or holders of the IP can exclude anyone else from using the IP in question) over ​distinctive signs​ – such as names, logos, colours, images, patterns, shapes, packagings of goods, or sounds – which identify your products and distinguish your goods or services from others.

 

2, How long can you protect your trade mark for?
In most countries, trade mark protection lasts 10 years, starting from the date of your trade mark application. You can then renew your trade mark protection for 10 years each time, for as long as you like. When you own a trade mark, you can sell it to someone else or give them permission to use it through a trade mark licensing agreement.

 

3, Notes
Prior to the filing of any new EUTM and certainly before putting the proposed trademark into use, trade mark availability searches are recommended to detect any registered trademark infringement risk as well as potential obstacles to trade mark registration. Although it is a single registration, protection may be refused by some or all IP offices of the designated countries. Please note that you can file an international application only with regards to the countries part of the so-called Madrid system (all EU Member States participate in Madrid system). It is administered by the World Intellectual Property Organization (WIPO) and offers a one-step solution for registering and managing trade marks worldwide.

 

4, Documents need to prepare
1)Business license or valid registration certificate (by legal person) or identity documents like ID card (by natural person);
2)Specific details of applicant such as name, nationality, address, postal code and contact number;
3)Electronic trademark sample (word marks or combination of words, letters and/or numerals. Figurative marks: logos, symbols, and design etc.) Colours or combinations of colours.
